Agreement

These Terms & Conditions are a legal agreement between you and Nora Karkach Consulting ("we", "us", "our") for the use of TCS Call Intelligence™ (the "Service"). By creating an account or using the Service, you agree to these terms.

The Service

TCS Call Intelligence™ provides AI-generated reviews of sales calls and transcripts for students of The Closers Standard. The reviews are generated based on the coaching method, scoring rules, and psychology framework configured in the platform.

We do not guarantee uninterrupted or error-free performance. AI-generated feedback is a coaching aid and not a substitute for your own judgment or legal, financial, or professional advice.

Payments and subscriptions

Memberships are billed monthly through our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all orders. Paddle provides customer service inquiries and handles returns.

Acceptable use

You agree not to misuse the Service. This includes, but is not limited to:

• Using the Service for unlawful purposes or to violate any applicable law.
• Uploading content you do not have the right to use or share.
• Attempting to interfere with the security, availability, or integrity of the platform.
• Reverse engineering, scraping, or probing the Service without authorisation.
• Impersonating another person or misrepresenting your identity.
• Using the Service to send spam, malware, or abusive content.

Intellectual property

All software, branding, documentation, and content provided by Nora Karkach Consulting remain our property or the property of our licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service during your active membership.

You retain ownership of the call transcripts and content you upload. By uploading content, you give us a limited licence to process it solely to provide the Service to you.

Account and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

Termination and suspension

We may suspend or terminate your access if you materially breach these terms, fail to pay fees when due, or pose a security, fraud, or abuse risk. Upon termination, your right to use the Service ends immediately.

Limitation of liability

To the fullest extent permitted by law, Nora Karkach Consulting is not liable for indirect, consequential, or special damages, including lost profits, data loss, or goodwill, arising from your use of the Service. Our aggregate liability is limited to the fees you paid in the twelve months before the claim arose.

Nothing in these terms excludes liability for fraud, death, or personal injury where required by law.

Indemnity

You agree to indemnify Nora Karkach Consulting for claims arising from your content, your misuse of the Service, or your violation of these terms.

Governing law

These terms are governed by the laws of the jurisdiction in which Nora Karkach Consulting operates, and any disputes will be resolved in the courts of that jurisdiction.

Changes to these terms

We may update these Terms & Conditions from time to time. Continued use of the Service after changes means you accept the updated terms.
